Terms of service

These Terms of Service apply to all use of this website and all purchases made through it. The Moogcos website is operated by MOOG LLC, a Washington limited liability company ("we", "us", "our"). By using the website or placing an order, you agree to these terms, our Privacy Policy, our Return and Refund Policy and our Shipping Policy.

1. Business buyers only

This is a wholesale store. By placing an order, you confirm that you are at least 18 years old that you are buying for resale or other business use, not for personal or household use, and that your delivery address is a business address. If you order for a company, you confirm that you are authorized to bind it.

2. Your account

You need an account to see wholesale prices and to order. You sign in with a one-time code sent to your email address. Keep access to your email safe, and tell us right away if you think someone else has used your account. The information you give us must be accurate.

3. Orders

  • Your order is an offer to buy. A confirmation email means that we received it, not that the goods are guaranteed. A contract for each item is formed when that item ships.
  • Each warehouse has its own order minimum. We can change minimums at any time.
  • Paid orders cannot be cancelled or changed by you.
  • We may cancel all or part of an order, for example if stock is unavailable, a price is wrong, an item cannot be delivered, or we suspect fraud. If we do, we refund the amount paid for the cancelled goods. That refund is your only remedy for the cancellation.
  • If part of an order is cancelled and the rest ships, the order remains valid even if the remaining amount is below a warehouse minimum.

4. Prices and payment

  • Prices are in US dollars and may change at any time without notice. The price that applies to your order is the one shown at checkout, unless it is an obvious error.
  • Payment is due in full at checkout.
  • Sales tax is added where it applies. If you have a valid resale certificate, send it to us before you order.
  • Volume discounts apply only as shown on the website and can be changed or ended at any time.

5. Products and stock

  • The barcode (GTIN) is the main product identifier. Check it before you order.
  • Product images are for reference only. The packaging, version or language of the item you receive may differ.
  • Stock figures are refreshed regularly but can change. They are not a promise of availability.
  • Unless a listing says it is a multipack, the price is for one unit. Items sold in cases must be ordered in multiples of the case size.

6. Delivery

Orders ship from the Netherlands directly to the business address you give at checkout. Delivery dates are estimates and are not guaranteed. Responsibility for the goods passes to you on delivery to the address you gave at checkout. Details are in our Shipping Policy.

7. Returns and claims

All sales are final. Problems with an order must be reported within the deadlines in our Return and Refund Policy. That process is your only remedy for damaged, expired, wrong, missing or lost goods.

8. Your responsibility as a reseller

  • You are responsible for checking that the goods are suitable for your market and sales channels, and for complying with all laws, licenses and marketplace rules that apply to your resale.
  • We do not guarantee that any marketplace will allow you to list an item.
  • We are an independent seller. Brand names on this website belong to their owners. Unless we state otherwise, we are not affiliated with or authorized by those brands, and you may not imply that we are.
  • We provide an invoice for your order. We do not provide certificates of origin, certificates of conformity or brand authorization letters.

9. Disclaimer of warranties

EXCEPT AS STATED IN OUR RETURN AND REFUND POLICY, THE WEBSITE AND ALL GOODS ARE PROVIDED "AS IS". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR LOST PROFITS, LOST SALES, LOSS OF BUSINESS, OR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE GOODS THAT CAUSED THE CLAIM. Any legal claim must be brought within one year after you knew or should have known of it. Nothing in these terms limits liability that cannot be limited by law.

11. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, labor disputes, war, government action, customs delays, pandemics, carrier disruption or system failures.

12. Your indemnity

You agree to cover our losses and reasonable legal costs that result from your breach of these terms, your resale of the goods, or inaccurate information you gave us.

13. Using the website

You may not misuse the website, interfere with its security, or copy its content, prices or data by automated means. We may suspend or close an account that breaks these terms.

14. Governing law

These terms are governed by the laws of the State of Washington, without regard to conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute will be resolved only in the state or federal courts located in King County, Washington, and both parties consent to those courts.

15. Changes

We may update these terms at any time by posting a new version here. The version in effect when you place an order applies to that order. If any part of these terms cannot be enforced, the rest stays in effect.
